Terms and Conditions

Terms and Conditions

Welcome to Marj Silver.

These Terms and Conditions set out how we sell our jewellery and related products, both online and at events or shows. By purchasing from us, the customer agrees to be bound by these terms.

1. About Us

Marj Silver sells jewellery and related products through our website and at events and shows.

  • The customer must be at least 18 years old to place an order, or have permission from a parent or guardian.

  • We may update these Terms and Conditions from time to time. The version in effect at the time an order is placed will apply to that purchase.

2. Products

We aim to provide clear and accurate images and descriptions of all our products. However:

  • Colours, sizes, and finishes may vary slightly due to natural variations in materials and differences in display settings.

  • Occasionally, items may sell out. If this happens, we will inform the customer as soon as possible and offer an alternative or a full refund.

3. Prices and Payment

  • All prices are shown in Pound Sterling (GBP, £) and include applicable taxes.

  • Prices may change from time to time, but this will not affect any orders that have already been confirmed.

  • Full payment must be received before items are dispatched or handed over.

  • At events, we accept the payment methods available on the day.

  • In the event of a pricing or typographical error, we reserve the right to cancel the order and offer the customer the option to reorder at the correct price.

4. Orders and Sales

Online Orders

  • Once an order is placed online, the customer will receive an email confirming that we have received it.

  • The order becomes legally binding once we confirm dispatch.

Event and Show Sales

  • Sales made in person at events or shows are completed at the point of purchase.

We reserve the right to refuse or cancel any order if there is a stock issue, a pricing error, or suspected fraudulent activity.

5. Delivery (Online Orders)

  • Estimated delivery times will be provided, but these are not guaranteed.

  • The customer is responsible for providing accurate delivery information. We are not liable for any loss or delay resulting from incorrect or incomplete delivery details provided by the customer.

  • If a parcel is returned to us due to non-collection or incorrect address details, the customer may be required to pay for redelivery.

  • We are not responsible for delays caused by postal services, customs processes, or other events beyond our reasonable control.

  • Ownership and responsibility for the goods pass to the customer once they are delivered.

6. Returns and Refunds

Online Orders

Under the UK Consumer Contracts Regulations 2013, the customer has 14 days from the date of receiving the order to change their mind and return eligible items.

  • Returned items must be unused, in their original packaging, and in a resalable condition.

  • For hygiene reasons, earrings and personalised items cannot be returned unless they are faulty.

  • The customer is responsible for the cost of returning items.

  • To arrange a return, the customer must contact us in writing (e.g. by email) within 14 days of receiving the goods. Returned items should be securely packaged, and proof of postage should be retained until the refund is confirmed.

  • Returned items will be inspected, and if an item has been used, tampered with or damaged, we may refuse a refund.

  • Approved refunds will be processed within 7 days of receiving the returned goods.

Faulty Goods

If an item is faulty, the customer has a statutory right to a full refund within 30 days of receiving the goods under the Consumer Rights Act 2015. After this period, the customer may be entitled to a repair or replacement in accordance with their statutory rights.

Event and Show Purchases

Under the Consumer Contracts Regulations 2013, the 14-day cooling-off period does not apply to purchases made in person.

  • Items purchased at events or shows are therefore non-refundable, unless they are faulty, misdescribed, or not fit for purpose.

  • If an item is faulty, the customer is entitled to a repair, replacement, or refund in line with their statutory rights.

7. Intellectual Property

All designs, images, text, and other content on our website, social media, and marketing materials are the property of [Trading Name].
They may not be copied, reproduced, or used without our prior written consent.

8. Our Responsibility (Liability)

  • We are responsible for ensuring that our products meet their description and are of satisfactory quality.

  • We are not liable for events outside our reasonable control, including delivery delays or indirect losses (for example, missed occasions).

  • Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be lawfully excluded.

9. Privacy and Data Protection

We take the customer’s privacy seriously. Personal data is handled in accordance with our Privacy Policy and all relevant data protection laws, including UK GDPR.

10. Promotions and Discount Codes

Any promotional offers, sales, or discount codes are subject to availability and may be withdrawn without prior notice. Only one discount code may be used per order unless stated otherwise.

11. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If the customer resides outside England and Wales, mandatory local consumer protection laws may also apply.
